Interpretation
"Buyer" means the legal person or their agent whose order for goods is accepted by the seller. "Goods" means the goods which the seller is to supply subject to their conditions. "Seller/Company" means CoffeeAid. "Conditions" means the terms and conditions of trading set out in this document which shall govern to the exclusion of any other terms and conditions. An "Order" means an order given orally or in writing using an acceptable form of communication (Such as Telephone, Letter, Facsimile, Online) and in both cases given by an authorised representative of the buyer. Singular words include the plural and vice versa and masculine includes the feminine and vice versa. Any recommendation or advice given by the seller or its employees or agents is acted upon entirely at the buyers own risk and accordingly the seller shall not be liable therefore.

Distribution of goods
To ensure your order is delivered we require a full delivery address and postcode, along with a contact telephone number in case there are difficulties finding your address. No responsibility is accepted for late or non deliveries caused by incorrect address details or lack of telephone number. Goods ordered will be dispatched as soon as possible. If the items are in stock, if any items are out of stock then the order will be delayed until all items are ready to ship. Any items that are not likely to be in stock for a long period of time will be removed from the order and the remainder sent. It is up to the customer to re-order these items. Delivery of goods is contracted out to a Third Party - we can not accept any responsibility for delays which occur while the goods are in the hands of third parties.

Damaged or missing items should be marked on the consignment sheet when you sign for the goods - always check the number of boxes you receive against the number of boxes on the manifest before signing for the goods. Where next working day delivery is available this is not guaranteed. Should the item be in stock we will send it with the carrier but we accept no responsibility should the goods not arrive next working day.

Prices
The sellers price list, catalogues and quotations do not constitute offers by the seller. Any typographical, written, clerical or other error or omission in any literature, quotation, price list, catalogue, invoice or other document or information issued by the seller shall be subject to correction without liability on the part of the seller. All prices shown are strictly nett and are subject to change without prior notification. All products will be invoiced at price ruling on the day of dispatch. All prices quoted are exclusive of Value Added Tax which will be charged at the rate prevailing at the time of delivery.

Payment on Account
Regular customers who wish to open an account with us can then choose to add their online order to their account when they order rather then pay using credit cards for each order. To open a credit account with us you will need to complete a credit application form. All our credit accounts are payable by Direct Debit on the 25th of the month following the invoice date. You are required as part of opening a credit account to complete a direct debit mandate so that we may take payment for your outstanding invoices when they are due. Errors & Omissions
The information included in this website has been checked for accuracy. CoffeeAid will accept no liability for any errors or omissions in this information.

Claims
Notification of non-arrival must be received within 2 days of invoice. Claims for damage must be in writing within 3 days. The buyer must examine the goods on delivery and sign the delivery note including a note on any damage or shortage. A clear signature must be given. Signatures endorsed unchecked or unexamined are not acceptable and will be regarded by the seller as a clear signature.

Losses
We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the website or when a contract for the sale of goods by us to you was formed.

Indemnity
The buyer shall indemnify the seller against all claims made against the seller in relation to the goods for which if the claims were made by the buyer against the seller the seller would have no liability. The buyer shall indemnify the seller against all loss, damage, injury, costs and expenses (including without limitation professional fees incurred) suffered by the seller.

Bankruptcy
If the buyer has a receiver appointed over any of its assets or (being an individual or firm) becomes bankrupt or compounds with its creditors or (being a company) becomes insolvent or goes into liquidation then without prejudice to any other right or remedy available to the seller the full price for the goods shall be immediately payable. The seller shall have the right to cancel or suspend any further deliveries to the buyer and if the price for any delivered goods is not forthwith paid the seller shall have the right to enter the buyers premises and repossess goods.

Delivery
Any dates and times are approximate and early or late delivery will not be an acceptable reason for refusing goods. The seller shall determine method, date and time of delivery. Postponement of delivery at the buyers request or the failure on the buyers part to accept delivery then the buyer shall be liable to pay the seller all extra expenses.
The delivery address should include a house number and street name along with a full valid postcode. A telephone number is required in case the delivery address cannot be found. The Carrier will deliver between 9am and 5pm Monday to Friday. Someone should be at the delivery address between these times to accept delivery. If you know you will not be in, please leave details of a safe place for the carrier to leave your order in the further details section. The goods are left in the location you specify at your own liability. If the goods are water damaged or stolen from the place you specify then CoffeeAid accepts no responsibility for this loss - this is at your own risk. If in doubt please provide a work address to deliver to. CoffeeAid cannot accept responsibility for late deliveries caused by poor address details, difficult access or no one being available at the delivery address to receive the goods. Next day delivery only applies to products in stock. Orders for products that are out of stock will be dispatched when stock is available. Please check stock availability if you are making a time sensitive order. All deliveries are made by third party carrier companies. When stock is available it will be sent next working day by carrier (Or Parcelforce Standard depending on the zone) but there is no guarantee the carrier will always achieve this.

Returns
The company does not operate a sales or return policy. Under EU regulations you have the right to cancel your order within 7 days of delivery, if you wish to cancel your order you must notify us in writing within 7 days of the goods being received. You will be responsible for return postage unless the product is defective through fault of our own. Please contact us before returning goods. Returned goods should be packaged as they were sent in the best method possible. Only goods returned in good condition will be credited. Goods ordered in error will be subject to a re-stocking administration fee of 15%, which means we will deduct 15% from the original order value to cover our own costs and refund you the remaining value. We cannot accept cancellation of purchases for foodstuffs which have been opened unless the product is defective.

Warranty
Goods purchased with a Warranty can be of two different types. Goods with a 12 months parts and labour warranty - you should contact the office to arrange for an engineer. Goods with a 12 months back to base Warranty - should the goods fail to work within the Warranty period then they should be packaged in the original box and returned to us with a cover letter explaining the defect. Once work has been completed on the machine it will be returned to you. Outside of warranty, labour/parts charges will be made as well as any carriage charges incurred.

Cancellation
After an order has been accepted by the seller, the order can only be cancelled with the sellers consent and the buyer shall be liable for any costs expended by the seller on account of the said order.
Please note these terms and conditions shall automatically take priority over the buyers conditions of purchase, regardless of their content, and the buyers act of providing an order constitutes an unqualified acceptance of the sellers terms and conditions of trading and this contract shall be subject to English Law.

Security
Our online store uses 128 bit SSL to transfer customer details to our secure server. Credit card details are encrypted using a 448 bit asymmetric key. In addition the store holds a digital certificate from Thawte that is compatible with Netscape and Microsoft browsers. Shoppers are also protected from fraudulent use of their cards in a "card not present" environment, by their card issuers. The card issuers provide the right for shoppers to dispute a transaction if the goods/services did not arrive or if the card was used fraudulently.

Purchases
Where items are out of stock or temporarily unavailable, then the bulk of the order placed will be dispatched. It is up to the customer to re-order out of stock items. We reserve the right to reject any order we receive. Should this occur, any money which has been received would be refunded. Normal CoffeeAid Terms and Conditions of Trading apply.
